1. Application form for the recordation of the intellectual property right, which shall include the following contents:

(1) the name, place of registration, or nationality of the owner of the intellectual property right;

(2) the title, contents, and relevant information of the intellectual property right;

(3) the status of execution of intellectual property licenses;

(4) the designation, origin, customs house of entry or exit, importer or exporter, principal features and price of the goods in respect of which the owner of the intellectual property right has lawfully exercised its intellectual property right; and

(5) the manufacturer, importer or exporter, main customs house of entry or exit, principal features and price of the known infringing goods;

2. Power of Attorney (Download) , executed by the owner of the intellectual property right;

  • Copy of his passport or identification card if the owner of the intellectual property is a natural person, or copy of its certificate of incorporation if the owner of the intellectual property is a legal person or other corporation;
  • Certification of the intellectual property right;
  • Certification of advance payment for the recordation;
  • license contract of the intellectual property right;
  • Photos of packaging of the goods and of the goods in respect of which the owner of the intellectual property right lawfully exercises its right;
  • Evidences of existing infringement, e.g., copies of legal documents from court or from administrative authority of intellectual property;
  • Other documents or evidences the General Administration of Customs may deem as necessary.

Notes:

a. Items 1-5 must be submitted at the time of filing the application for the recordation.

b. Items 6-9 can be submitted if they are necessary.

c. If the General Administration of Customs questions the verity of the relating documents or evidences provided by the owner of the intellectual property right, it may ask the owner to submit notarized or legalized ones.

d. If the relating documents or evidences provided by the owner of the intellectual property right are in foreign languages, Chinese translations of them shall be attached.
