Reexamination

If not satisfied with the rejection made by State Intellectual Property Office of P.R.C., the applicant may submit a request for reexamination to the Patent Reexamination Board within three (3) months from the date of receipt of the rejection decision.

The applicant may, at the same time, make amendments to the application documents to overcome the deficiencies as indicated in the rejection decision.

Filing Requirements for Requesting Reexamination:

1. A duly executed Power of Attorney (Download);

2. Form of "Request for Reexamination";

3. Reasons and evidences;

4.Amendments, if any.

On receiving an unfavorable decision on reexamination issued by the Patent Reexamination Board, the applicant may institute legal proceedings at the court within three (3) months from the date of receipt of the notification.
